These terms govern your use of the BayPay website, driver app and operator portal (the "Service"), provided by [BayPay Ltd] (company number [company number], registered office [registered address]) ("BayPay", "we"). By creating an account or paying for parking through BayPay you agree to these terms. Please also read our Privacy policy.

1. Our role

BayPay is a payment and session-management platform. Car parks listed on BayPay are owned or managed by independent operators ("Operators"). When you pay for parking, BayPay collects the parking charge as agent for the Operator; the contract to park, and the Operator's conditions for using the car park, are between you and the Operator. BayPay does not own, manage or patrol car parks and is not responsible for the availability of spaces, the condition of the car park or your vehicle while parked.

The total shown before you pay is made up of the Operator's parking tariff and, where the Operator has chosen to apply one, a convenience fee for paying through BayPay. Any convenience fee is displayed separately before payment and on your receipt. Your bank or card issuer may apply its own charges for foreign-currency cards.

7. Digital permits

Operators may issue digital permits to named individuals for specific car parks. A permit is valid only for the registration attached to it and within the dates shown. Permit holders may change the attached vehicle in their account; changes take effect immediately and apply to subsequent checks. Operators may suspend or revoke permits under their own terms with the holder.

We may update these terms; continued use after a change means you accept the new terms, and material changes will be notified in the app or by email. If any part of these terms is found unenforceable, the rest continues to apply. These terms are governed by the laws of England and Wales and the courts of England and Wales have jurisdiction (residents of Scotland or Northern Ireland may also bring proceedings in their local courts).
